Terms of Service

Last updated: June 28, 2026

These Terms of Service (“Terms”) govern your access to and use of the website operated by Andaluz Inc. (“Andaluz,” “we,” “us,” or “our”) and any related information, content, or services offered through it (together, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Our Services

Andaluz designs and builds custom software for the businesses we partner with. This website presents who we are and what we do, and lets you get in touch or book a call to discuss working together. The website itself does not deliver software development services; any engagement to build software is governed by a separate written agreement between you and Andaluz.

2. Eligibility

You must be at least 16 years old and able to form a legally binding contract to use our Services. By using the Services, you represent that you meet these requirements and that any information you provide is accurate and complete. If you use the Services on behalf of a company or other organisation, you represent that you have the authority to bind that entity to these Terms.

3. Acceptable use

When using our Services, you agree not to:

4. Intellectual property

The Services, including all text, graphics, logos, the Andaluz name and brand, designs, and underlying code, are owned by Andaluz or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal or internal business purposes. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Services without our prior written permission.

5. Enquiries and bookings

When you contact us or book a call, you agree to provide accurate information and to use these channels in good faith. Booking a call does not create any obligation on either party to enter into an engagement. Any work we agree to perform will be set out in a separate proposal, statement of work, or contract, which will take precedence over these Terms with respect to that work.

Our Services may link to or rely on third-party websites and services, such as scheduling and email tools. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of those services is governed by their own terms and privacy policies.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to the practices described there.

8. Disclaimers

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the website is complete or current.

9. Limitation of liability

To the maximum extent permitted by law, Andaluz and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Services. To the extent liability cannot be excluded, our total liability arising from these Terms or the Services shall not exceed one hundred US dollars (USD 100).

10. Indemnification

You agree to indemnify and hold harmless Andaluz and its officers, employees, and partners from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of your misuse of the Services or your breach of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

12. Termination

We may suspend or terminate your access to the Services at any time, without notice, if we believe you have violated these Terms or to protect the Services, our users, or third parties. The provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

13. Governing law

These Terms are governed by the laws applicable at the place of Andaluz’s principal place of business, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of that location, unless otherwise required by applicable law.
